Driver Found Dead of Gunshot Wounds After Crashing into Home

The Phoenix police have found the driver of a vehicle. The driver was found dead and the cause was gunshot wounds. He was found after the car crashed into a Phoenix home on Tuesday night.

According to a Phoenix Police spokesman, Officer James Holmes, the Phoenix police were called to the home near 20th Street and South Mountain Avenue around ten, thirty in the evening on Tuesday. This was after a resident had called and said a car had driven into a home.

Gunshot Victim Found Dead

The investigators found the thirty-six year old man inside of the car. The man was dead. Officer Holmes said that they realized after examining the man that he had a gunshot wound. Police have not identified the victim at this time.

According to Officer Holmes, no one else was in the vehicle when it had went through the home’s garage and then into the bedroom of the home. A woman and her boyfriend were however, inside of the home at the time of the crash. They luckily did not suffer from any injuries.

Blanca Fernandez was in her bedroom when she hear a large crash. She though someone had broken into their home so she immediately ran into her daughter’s bedroom, however she could barely see anything because the furniture had been pushed so far back into the room.

Blanca Fernandez Statement:

We went outside, and that’s when we saw the vehicle completely through the garage in her bedroom.

Blanca lives in the house with two daughters. The girls are four years old and an eighteen year old. Luckily both girls weren’t home at the time of the crash. The car had hit an armoire in the four year old’s bedroom. The impact moved it into the bed then that pushed the rest of the furniture into the doorway.

 Fernandez Statement:

Had she been home, she would have been sitting there when it happened.

The investigation happened after the crash and lasted until around four o’clock that next morning. Fernandez was not allowed in her house while the investigation was going on since it was now a crime scene. The authorities finally removed the body and the vehicle then called in a clean up crew to clean the garage.

The police say that no one had witnessed the shooting and there was no motive or a suspect at this time. However there was one resident who reported that they had heard shots fired in the area.

Police are asking anyone with any information about this case to call Silent Witness at (480) WITNESS.

The highly skilled Attorneys at Criminal Defense Lawyers PLLC advise and represent people facing criminal charges for domestic violence often described as Spousal Abuse, Spousal Battery or Domestic Dispute, such charges do not always reflect a case between married people, but include those living in the same location (cohabitation), or sometimes just engaged in a domestic (dating) relationship.  Such cases can also lead to violation of a restraining order or protective orders.  They are NOT the same as a Domestic Violence Restraining Order however.

Crimes Against Children

Police Fight for Crimes Against Children

Child abuse or crimes done to children is absolutely disgusting. In my opinion it’s one of the worse forms of abuse. This is probably why the abusers doesn’t last long in prison.

According to the Woonsocket Police, on Friday they were able to arrest a man who was accused of crimes against children.

The police said that they found twenty-nine year old, Rodolfo Ortiz Rivera. He was hiding out in Springfield, Massachusetts. The police found him just a day after they requested public assistance in finding him.

He must be a real piece of work because he had a warrant out of his arrest for first degree child molestation, second degree child abuse, as well as solicitation of a six year old girl.

Women Charged for Child Abuse

Being a woman and a mother, you would think that a woman wouldn’t want to harm any child. What happened to their motherly instincts? Just because a child has something wrong with them medically doesn’t mean that your love for them stops or your care.

Two women are now being charged for their part in a 2016 case where the five year old little boy suffered seizures and broken bones after he was hit with a hammer. The women enter “please of no contest to all charges”. This is happening in Muskogee County.

Just because they plea no contest doesn’t mean they are guilty or that they are innocent. They just mean that they aren’t admitting to the guilt but have no defense for themselves. So pretty much they’re guilty but don’t want to admit it.

Twenty-six year old Kayla Jones and twenty-nine year old Rachel Stevens were both sentenced to twenty years in jail. They are allowed a one year judicial review.

Both of the young women were charged with one count of child abuse by injury as well as one count of child neglect.

Another Example of Children Being Abused

Boys fight. When a son turns teenager, the father and son are bound to butt heads. But taking a clothes hanger and choking a five year old is a little over the top. No child, no matter how old deserves that.

A Mesa man is accused of choking his five year old son with a clothes hanger. According to the reports from the Mesa police on September 12th they were contacted by the school officials. According to the school a five year old little boy showed up to school with marks on his little chest as well as his neck.

The nurse documented the “cuts and scratches on the child’s head, chest, and marks on his arms”.

Crimes Against Children in Arizona

The little boy told the authorities that his father had choked him with a white clothes hanger and cut his little arm with a  knife. His father is thirty year old, Patrick Lamont Smith.

The police went to the home near Lindsey and Broadway roads where they found some heartbreaking evidence. There were other children in the home and agreed with the victims story. They even told the police that the little boy was “the only one abused that day”. How sad. How long have these poor children had to suffer through this with that man?

The suspect, told the police that yes he does have a white clothes hanger. He uses it to threaten the children when they misbehave.

He did admit to grabbing and yelling at the poor child. However, he denied choking him. He did tell the police that he grabbed the little boy by the back of his neck. Which is horrible in itself.

According to reports, Smith has been charged with aggravated assault as well as child abuse.

Child Sexual Abuse Case in Phoenix

Man Charged With Child Sexual Abuse

Child sexual abuse is sadly something that never goes away. It seems like more and more people are abusing children. Luckily they’re getting caught more and more as well.

Recently a man has been charged for two counts of child sexual abuse, soliciting a minor for indecent exposure, as well as possession of juvenile pornography has plead guilty to all of the above charges.

According to reports, sixty year old, Glenn Douglas Smith will receive thirty years in prison for three counts and twenty years in prison for the fourth count. He will also have to pay a $1,000 fine for each of those charges.

All but the first 25 years of the 30 year sentences were “suspended”. Each sentence is to “run concurrently”.

The reports say that Smith will not be able to try for parole for at least twenty-one years and three months. This is because it’s a child sexual abuse crime. When it’s a child sexual abuse crime, at least 85% of your sentence must be served before you can be considered for parole.

Of course after Smith gets out he will have to register as a sex offender.

Sexual Offender

According to the Department of Corrections, Smith actually has a past of similar  convictions. His past record includes two counts of lewd or indecent proposals/ acts to a child.

However, since the Oklahoma Sex Offender Registration Act didn’t go into effect until November 1, 1989 and he was convicted in June of ’89 he never had to register as a sex offender.

This time around Smith pleaded guilty to the accusations of sexually assaulting a thirteen year old on New Years Eve as well as performing oral sex on a child.

A woman “provided” the child for Smith to sexually assault in exchange for money is now being held without bond and is awaiting trial.

Her name is Heather Barbee and she is thirty-four years old. She is accused of sending kids to perform sexual acts with an adult. The suspect then received the payment from the adult in exchange for “not reporting the incident to the police”.

Barbee is facing two counts of enabling child sexual abuse and will return to court on October 12th.

Eighteen Year old Charged with Sexual Abuse

An eighteen year old young man has been charged with child sexual abuse. The alleged abuse supposedly happened several years ago when the victim was only seven years old.

Eighteen year old, William Norfleet is now being charged for the following after the young, brave girl’s “disclosure” to a relative. The first time she told was in August in 2016 then again last Spring. Due to the closeness of the reports,  authorities started an investigation into the matter.

Apparently Norfleet told the police investigators about both of the incidents. Reportedly they both included oral sex with the victim in August 2016 and another last Spring.

The charges however, pertain mainly to the references made about this year’s incident.

The reports said that the incident happened at an address in the N. Phoenix area.

A text message was found that Norfleet “explains” the issue to a relative.

Child Abuse Cases in Phoenix

Phoenix Child Abuse

Jury selection began on Wednesday in one of the worst cases of child abuse and neglect reported in Phoenix. Nearly six years ago, 10-year-old Ame Deal was found dead inside a padlocked plastic storage box. The girl’s aunt and uncle were charged with first-degree murder and now the trial for one of them is about to get underway.

Police said the conditions Ame lived in were cruel — she endured a history of abuse and it was all under the hands of her relatives.

According to the investigation, Ame was forced to eat dog feces, crush aluminum cans with her bare feet and get into the storage box she eventually died in back in 2011.

Ame’s cousin, 28-year-old Samantha Allen, faces several charges in the girl’s death, including four counts of child abuse, one count of conspiracy to commit child abuse and one count of first-degree murder.

Police say Allen padlocked the girl in the box to punish her for stealing a popsicle. Other adults in the home originally claimed Ame hid in the box during a game of hide and seek.

The box was less than three feet long, one foot wide and a foot deep. Ame stood about four feet tall and weighed nearly 60 pounds.

Prosecutors are seeking the death penalty against Allen and her husband, 28-year-old John Allen. Three other relatives, including an aunt who served as Ame’s legal guardian, and her father, are in prison serving sentences for abusing Ame.

Jury selection is expected to last two weeks. Opening statements begin May 30.

Tulsa Child Abuse Case

A Tulsa County jury has recommended a couple accused of child neglect in the 2016 death of a 2-year-old child to serve 30 years in prison.

On Monday, the jury acquitted 31-year-old Branden Taylor on a child abuse murder charge and found the toddler’s mother, 26-year-old Tina Morgan, not guilty of permitting child abuse. But both defendants remain in prison for child-neglect convictions.

Oklahoma State Medical Examiner Dr. Andrea Wiens testified in court last week that the child died due to blunt force trauma.

Assistant District Attorney Sarah McAmis said evidence shows Morgan and Taylor violated their duties as the child’s caretakers. McAmis alleged the defendants didn’t notice the child was dead until nearly 24 hours after he was injured.

Both are scheduled for sentencing May 30.

Child Abuse in Arizona

A father in Goodyear is accused of taking drastic measures, like using a stun gun, on his young son.

According to court documents, Daryl Ingram allegedly used several several forms of physical punishment on his 11-year-old son for the past year. The documents even indicated Ingram used a stun gun to discipline his son.

The father is now charged with aggravated assault and child abuse, abuse that police said was possibly caught by the eyes of the child’s bus driver.

The victim reportedly told police last week that the driver saw Ingran strike his son with a cane. When the child got on the bus, the driver asked him what happened, to which the child reportedly said his dad hit him. The child reportedly showed the driver an apparent injury on his shoulder.

DCS and Goodyear Police were notified by the alleged victim’s schools, and during extensive interviews, the alleged victim told police Ingram used a stun gun on him quite often, for reasons such as not doing his homework, along with other bad behavior. Investigators also found injuries on the boy’s shoulder.

When detectives caught up with Ingram at his home, he reportedly said he did not have a stun gun, but used a stun gun app on his phone instead. A stun gun, according to court documents, was found by police in Ingram’s oldest son’s car. Ingram, at that point, told police he did in fact use a stun gun on his son, but only as a reference to never use it.

Ingram is reportedly out on bond. FOX 10 Phoenix has gone by the family’s home in Goodyear, but no one answered the door. Neighbors said Ingram was well known, and were surprised by the allegations.

Phoenix Child Abuse Cases

Three Phoenix daycare workers have been arrested after one allegedly hitting a child with a broom and two others interfered with the subsequent investigation.

Phoenix police said officers responded to the Brighter Angels Daycare Center near Central Avenue and Baseline Road on Feb. 17 for a report of an injured child.

When officers arrived on the scene they found evidence that 37-year-old Lillie Adams struck a 21-month-old child with a broom while she was cleaning with 10 toddlers in the room.

According to a police report, Adam was sweeping the room and accidentally knocked over a toy kitchen set. The victim crawled under a table and when he refused to move, the suspect allegedly hit the child in the face two times with the broom.

Police then arrested Perla Denise Sierra Duarte, 26, and Ruben Sandoval, 51, after both are accused of hindering prosecution and failing to accurately report the injury to police. Sierra Duarte is the director of the preschool, and Sandoval is the owner.

Catherine Masters’ sister has three kids enrolled at the daycare.

“They need to be put behind bars because this is just unacceptable,” Masters said. “They have no business hitting someone else’s child and they know better.”

According to a police spokesperson, there’s surveillance footage of Adams allegedly assaulting the child with the bristles of the broom.

The 21-month-old child was taken to a local hospital and his mother was notified of the incident.

Daycare employees told the victim’s mother that the child suffered a fall, however, after the child was hospitalized it was discovered that the injuries were inconsistent with their story.

Adams resigned from the daycare the day of the incident.

Adams was arrested and booked on one count of child abuse.

Family friends spoke out in defense of Adams Friday, saying that she wouldn’t do something to hurt a child.

“She is a very loving woman, to children, teens and adults,” said Christina Corral, a family friend. “These are false accusations, and I wish they would just go away.”

Corral says she thinks Adams was framed, and that the evidence will show her innocence as the case develops.

Phoenix Child Abuse Involving Guns

Phoenix Boy Shot by Two Year Old Brother

I’ll never quite understand how kids can get enough alone time to kill each other. Where were their parents? Why were the guns not locked up? Why did they kids not know that they were dangerous? If they did know they were dangerous why did they feel comfortable enough to go into your room and get the guns. I’m for guns but I’m definitely for striker gun laws. Of course you never know what could happen until your in that situation.

Sadly a nine year old little boy shot and killed by his two year old little brother. The parents of the boys have now been arrested and are both now facing charges for their suspected roles in the incident.

According to the Phoenix police, they were working to confirm the details of the situation. The children’s twenty-eight year old mother, Wendy Lavarnia worked with the investigators.

Phoenix Police Investigate Toddler Being Shot

The Phoenix police confirmed that the nine year old was Landen Lavarnia. He died at the hospital after being on life support since Monday. This was after his two year old little brother shot him in the head.

Lavarnia was booked for investigation of four counts of child abuse. According to the reports her bond was set at $25,000. Her thirty-one year old husband, Kansas Lavarnia reportedly had a felony record. He was arrested for suspicion of illegally possessing a firearm. Police are still investigating, it’s unclear if Kansas was at home at the time of the shooting.

Child Shot

To continue on with that tragic story, Phoenix police arrived to the scene around 3 p.m. that Monday. According to the reports the home was located near 35th and Rosewood avenues. When they got to the scene I’m sure it was something none of them wanted to see, they saw that the older boy was shot once in the head.

Wendy had told the authorities that she had placed the 9mm pistol (unholstered and loaded) onto the master bed, which was next to her two year old and four year old sons. According to Wendy the two year old picked up the gun and then fired it, hitting the nine year in the head as he innocently played his video games just a few feet away.

She also said that the gun didn’t have an “safety” on it. She often let the two year old practice pulling the trigger when the gun was unloaded. Not the safest toy to allow your two year old to play with lady.

Neighbor’s Statement:

It’s tragic… If that happened here, I would die. It would be devastating beyond belief. It’s devastating just having it next door.

The neighbor said that the husband, Kansas was a hard worker that he drove a large crane truck back and forth from Nevada to Arizona. Other neighbors also called him a nice guy.

Neighbors say they never saw the nine year old little boy but would often see the toddler outside in his diaper running around. Which is odd, why wouldn’t all the kids be outside together? Out of all the time of them living there the neighbors never seeing a nine year old kid outside is a bit odd.

Phoenix Manslaughter Lawyer

At the Phoenix based Offices of Criminal Defense Lawyers PLLC, we have defended many clients charged with a violent crime, including murder charges and other high-level violent crimes. We can provide the strong defense you need if you have been charged with voluntary manslaughter or involuntary manslaughter.

If you discovered your spouse in bed with a lover and as a result killed your spouse in a sudden rage, you may have been charged with first-degree murder. However, you may only be guilty of voluntary manslaughter, an offense that carries a maximum prison sentence of 11 years, as opposed to a life sentence.

Manslaughter is defined as the unlawful killing of a human being without malice. The term malice is used in a highly technical sense and does not simply imply a feeling of anger.

Types of Manslaughter Defenses

If you have been charged with murder and the evidence is stacked against you to show that you did unlawfully kill another person, seeking a conviction to the lesser charge of voluntary manslaughter may make a significant difference in your case.

To effectively raise such a defense, you must be able to establish that you were provoked, that a reasonable person in such a situation might be similarly provoked to kill, and that you did not have sufficient time to cool off and further contemplate your actions. If retained as your counsel, we will thoroughly investigate the facts of your case to determine which defense strategy gives you the best opportunity to protect your freedom.

Types of Manslaughter Cases in Phoenix

In the state of Arizona, you may be charged with involuntary manslaughter under two separate circumstances:

  • If you committed a crime (other than a felony) and unintentionally caused the

death of another person.

  • If you were engaged in a lawful act that might cause death and acted without

“due caution and circumspection.”

Manslaughter Conviction and Sentencing

A conviction for involuntary manslaughter carries a maximum sentence of four years imprisonment. If you caused the unintentional death of another person and you were not committing a crime, it is not sufficient for the prosecution to allege that you made a mistake. The phrase “without due cause and circumspection” implies something more than a simple mistake. Our Phoenix Attorneys can raise a number of issues and defenses on your behalf to raise the strong defense you need. A plea to a lesser offense or a plea that allows you to avoid a criminal conviction may be possible depending on the facts of your case. If you choose to fight your charges at trial, we have the skilled trial lawyers to aggressively defend your rights in the courtroom.

Child Abuse Cases in Phoenix

Child Abuse in Phoenix

I’m sorry but to me, and to a lot of people child abuse in any form is one of the worst crimes that could ever be committed. A man who was accused of child molestation and continued sexual abuse in now behind bars.

The United States Marshals Service arrested thirty-nine year old, Marian Tigla. They arrested him in Waterloo however, he’s from Phoenix, Arizona.

There are several charges against Tigla which include: child molestation, sexual conduct with a minor and continued sexual abuse. He is now in the Black Hawk County Jail and is awaiting extradition back to Arizona.

Hopefully that doesn’t take too long and he gets his sentencing rather fast.

Day Care Employee Arrested for Child Sexual Abuse

When you send your kids to school you trust that the people working at the day care or school is there for trustworthy reasons. That they love children in a non perverted way. However, that’s sadly not how the world works all the time.

Sadly, a former employee at a Gilbert day care has been arrested for allegedly inappropriately touching little girls.

The police say that twenty-four year old, Tanner Anthony Lang is going to face two charges of felony child abuse.

According to the reports, the alleged incidents happened at the Children’s Learning Adventure Center which is in Gilbert. Lang had been working there as a trusted teacher. Police say that it happened at an after school program, in a course of a year between September 2015 and May 2016.

According to one of the mothers, her daughter was a six year old little girl and she told her about what happened.

The innocent little girl told the police that the man had “put his hand down the back of her pants and touched her buttocks with his hand”. How sickening to hear. As a parent, I can’t imagine the pain the mother feels for her child. The rage she also feels.

There was also a second victim that also came forward, that also reported something similar during the same time frame.

Of course the police questioned Lang, he admitted to knowing the girls but did not confirm nor deny the accusations.

Children’s Learning Adventure issued this statement regarding the incident:

Children’s Learning Adventure has learned of the arrest of a former staff member for two counts of aggravated assault by an adult on a minor. This former staff member was placed on leave as soon as the allegations were brought to our attention and was subsequently terminated once we learned of his arrest.

Children’s Learning Adventure cooperated with the Gilbert Police Department in its investigation of this matter and will continue to do so. As this investigation is ongoing we are not privy to details regarding actions that led to the charges. As Children’s Learning Adventure believes that open communication and transparency is essential, we will communicate directly with our families when additional information becomes available. In the meantime, center and corporate management are available to discuss this situation with any parent who may have questions or concerns.

At Children’s Learning Adventure providing a safe and nurturing environment in which children can learn and grow is our utmost priority. All teachers and staff have undergone careful employment screening including criminal background and CPS registry checks. Closed circuit camera systems and open classrooms with glass walls provide for ongoing observation of classroom activities.

Center and corporate management will continue to be hyper-vigilant and engaged to insure the safety and well being of the children in our center. Creating a caring environment in which children develop a life-long love of learning continues to be our mission and we are committed to taking all actions necessary to insure we meet this objective.

Ohio Woman Arrested for Child Stabbing

A Ohio woman admitted to fatally stabbing her five month old son. She claimed she was “possessed and not in control of her actions”. Right.  Why even have kids if you’re just going to do that? Well now she’s going to face a first degree murder charge.

She’s only twenty-nine years old and her name is Andrea Portillo. At first she was being held on suspicion of a second degree murder and child abuse for the death of her infant son, however “mental illness” played a role in the crime.

I don’t think that people should be allowed to kill people and then get to claim, ” oh, they were crazy” then get a lesser sentence. Sometimes, yes! But in cases like this, probably not. She was relatively young and probably just tired of being a mom.
