However, you may only be guilty of voluntary manslaughter, an offense that carries a maximum prison sentence of 11 years, as opposed to a life sentence.

Manslaughter is defined as the unlawful killing of a human being without malice. The term malice is used in a highly technical sense and does not simply imply a feeling of anger.

Types of Manslaughter Defenses

If you have been charged with murder and the evidence is stacked against you to show that you did unlawfully kill another person, seeking a conviction to the lesser charge of voluntary manslaughter may make a significant difference in your case.

To effectively raise such a defense, you must be able to establish that you were provoked, that a reasonable person in such a situation might be similarly provoked to kill, and that you did not have sufficient time to cool off and further contemplate your actions. If retained as your counsel, we will thoroughly investigate the facts of your case to determine which defense strategy gives you the best opportunity to protect your freedom.

Types of Manslaughter Cases in Phoenix

In the state of Arizona, you may be charged with involuntary manslaughter under two separate circumstances:

  • If you committed a crime (other than a felony) and unintentionally caused the

death of another person.

  • If you were engaged in a lawful act that might cause death and acted without

“due caution and circumspection.”

Manslaughter Conviction and Sentencing

A conviction for involuntary manslaughter carries a maximum sentence of four years imprisonment. If you caused the unintentional death of another person and you were not committing a crime, it is not sufficient for the prosecution to allege that you made a mistake. The phrase “without due cause and circumspection” implies something more than a simple mistake. Our Phoenix Attorneys can raise a number of issues and defenses on your behalf to raise the strong defense you need. A plea to a lesser offense or a plea that allows you to avoid a criminal conviction may be possible depending on the facts of your case. Most the time when you hear or think about a murder, you think of how awful it is. You’re always expecting the worse like someone got stabbed or shot. This case however, is very gruesome.

A woman from New York City, is now facing murder charges after the police found a pregnant mother’s baby cut from her womb. Talk about a painful way to go.

The woman, Ashleigh Wade is only twenty-two years old and she’s being charged with murder as well as: criminal possession of a weapon and several other charges. The New York Times reports that her charges are all related to the stabbing death of Angelikque Sutton.

According to the authorities, Ashleigh had been telling people for month that she was expecting a baby. She would even post a baby registry and due date online. However, Ashleigh was never pregnant, according to the investigators.

Ashleigh Wade was reportedly friends with Angelikque Sutton back in Elementary School, the two had reportedly reconnected just before Wade invited Sutton to her apartment. The police found Sutton’s body at the apartment as well as Wade being there.

When the police first got to the scene, Ashleigh claimed that the newborn baby was hers. However, she later changed her story and claimed that she stabbed Sutton in self-defense. Ashleigh also told the police that she cut out Sutton’s unborn child to save the baby.

The local neighbors told the local NEWS that deceased Sutton would have been a great mother if she would have had the chance.

Neighbor Monica Keller’s Statement:

She would have been the best possible mother to that baby. Devoted to that baby, making sure that baby had everything it needs.

Luckily the poor defenseless baby survived, sadly his or her mother didn’t. The baby is reported to be in good health.

The shooting happened around two, thirty in the evening. The suspect just walked up to the victim and shot him.

Mr. Holmes said that the suspect had walked only a short distance from the scene and then sat down under a tree while holding his weapon. The responding officers were luckily able to convince him to give him self up after some negotiations. Holmes also stated that the victim had died from his gunshot injuries. A police lieutenant who was at the scene told the local news that the suspect and the victim were related.

 Police Investigate Car Wash Shooting

The police were able to identify the victim. The Phoenix Police say that the victim was a fifty-four year old man named David Pacheco-Chavez. The car was that he was shot and killed at was the Los Olivos Car Wash.

Police are unsure of why the suspect would shoot his family member. Especially since the victim and suspect lived together. But apparently there might have been an on-going dispute between them. The victim, David Pacheco-Chavez was actually an employee of the Los Olivos Car Wash.

This might sound like a strange shooting and it is, but sadly these kind of random shootings aren’t uncommon. It’s sad that these family members couldn’t work out their differences peacefully instead of it ending with one of their lives.

Man Charged With Several Charges in Kidnapping 8 Yrs Old Girl

Man Arrested for Disappearance of 8 Year Old Little Girl

A man is in some serious trouble after being previously questioned in the disappearance of an eight year old little girl. The man has now been booked into the Mohave County Jail for the following charges: first-degree murder, kidnapping, as well as shoplifting. That poor little girl.

Chief Brian Williamson from the Bullhead City Police, confirmed that twenty-six year old Justin James Rector was indeed taken into custody for the above charges including the death of the eight year old Isabella Grogan-Cannella. The innocent little girl was reported missing last Tuesday. According to the local authorities, on Wednesday Isabella’s lifeless body was found in a shallow grave near her home. Rector was taken into custody on Thursday.

Family Friend Murders 8 Year Old Little Girl

According to chief Williamson, Rector was a family friend that had been visiting and staying with the family at their home for a few days. Isabella was last seen with Rector at around 11:30 on Monday night. She was seen by her ten year old sister with the boy. Isabella was reported missing around 1:30 a.m. on Tuesday morning.

Chief Williamson also said that Rector had went to the local Walmart to shoplift some shoes, underwear, and a shirt to change into. Rector admitted to actually hiding his old outfit along the highway. Rector was first arrested for the shoplifting and then held in the jail so that the investigators could look into Isabella’s disappearance. The detectives were able to find the shoes and shirt, as well as the surveillance video from the store which showed the evidence of Rector shoplifting. Rector had at first told the investigators that he had gone to a friends house after leaving Isabella’s home, however they were unable to confirm that. The investigators did find a set of show prints at the site where Isabella’s body was found. The shoe prints did match Rector’s old shoes.

The court documents read that Isabella was found in the same shirt she was wearing when she went missing, however she was found not wearing anything on her lower half. They are going to preform an autopsy to determine the cause of death. Rector didn’t deny killing the 8 year old Isabella, he did say he couldn’t talk about it and wanted an attorney.

According to the investigators, they aren’t sure of a motive for the girl’s murder. The investigation is ongoing at this time and police are unsure of future charges or arrests at this time. There were several other people at the house when Isabella disappeared.  Child Protective Services are also involved, but it is unsure what for at this time.
