Arizona Statutes, Titles 28-1381, 28-1382 and 28-1383 acknowledge the following Blood Alcohol Concentration (BAC) as representing Driving Under the Influence of an illegal substance that impairs the driving ability and judgment of a motor vehicle operator.

 

Arizona Blood Alcohol Concentration (BAC) Ratios:

  • Under 21 years of age: 0.00% (Zero Tolerance)
  • 21 years of age or older: 0.08%
  • Commercial Vehicle Operator: 0.04%
  • Extreme DUI: 0.15% or higher

 

DUI Offenses

Penalties for a 2nd or 3rd DUI offense will be met with greater and greater consequences in fines, jail time and license suspension, but perhaps the greatest detriment is the impact that DUI charges have on your driving and criminal record.

  • 1st Offense carries a minimum of 24 hours in jail and up to 10 days incarcerated, a $250 base fine and a 90 to 360 day license suspension.
  • 2nd Offense carries a minimum of 30 days in jail and up to 90 days incarcerated, a $500 base fine and at least one year of license suspension.
  • 3rd Offense carries a minimum of 4 months in jail, a $750 base fine and at least one year of license suspension with the possibility of permanent suspension.
