Phoenix Struggles With Murders

Murder in Phoenix

Owning a family business has to be stressful. There’s a lot of hours that goes into a business and as well as a lot of together time that might not be good for some families. No matter what you shouldn’t murder your family. So before starting a venture, you might want to be sure that you all can stand to be around each other, even when things get stressful.

According to the police, five relatives have been found dead. This was due to a suspected murder/suicide in a Phoenix home. Police think that the fight was over the family’s limo business.

The officers say there were three of the brothers, their mother, and one of the men’s wife was all shot to death inside of the home. The police think that one of the brothers, fifty year old Driss Diaeddinn had shot the other four and then turned the gun to himself.

His brothers: thirty-eight year old, Reda Diaeddinn and fifty-six year old, Dodi Fayed were found dead in one area of the house.

The seventy-six year old mother, Kenza Benzakour and his sister in law, twenty-six year old MEriem Ben Yahia were also among those of the dead.

Family Shooting

Luckily his wife, a second female relative and two children managed to get away from the incident unharmed.

According to Sgt. Trent Crump, the victims were in an argument over the family owned business then the shooting began.

The family owns a Phoenix limousine company.

Luckily the suspect’s wife escaped with the two children, a three year old and an infant, and was able to call the police to report the incident. Cops heard the gunshots in the background when the woman was making the call to them.

The officers rushed to the scene and the house stayed barricaded for hours. Witnesses said that they could hear sounds of “muted gunshots” just an hour after the standoff began.

After an hour of waiting, a second female was able to escape the murder scene. She was “distraught” after her escaped and told the authorities that she was hiding in a bathroom.

The family had origins in Morocco so during the HOURS of standoff the police had used a megaphone and was speaking Arabic to try to communicate to anyone that might be alive or the suspect.

The SWAT team didn’t waste any time, they sent in robots to search it before the dogs and officers entered the home.

Police are doing a thorough search to see if the family had a history of domestic violence. Neighbors say that the family as “invisible”.

Hiring the Right Homicide Lawyer in Phoenix

Having a skilled homicide defense attorney is important in any criminal case, but it is even more critical in a murder case. To properly defend a client against a murder charge, a defense lawyer must be prepared to effectively challenge the prosecution’s evidence. To do so, a Phoenix Murder Defense Attorney must be prepared to effectively cross-examine the prosecution’s witnesses, including any expert witnesses.

Expert Witnesses

In some cases, a Phoenix Homicide Defense Attorney may need to use expert witnesses on behalf of the defendant to challenge forensic evidence, ballistics evidence and other scientific evidence presented by the prosecution. We are prepared to do so and have worked with expert witnesses in the past to provide a vigorous defense on our clients’ behalf.

In addition to fighting your charges at trial (or seeking a case dismissal for lack of probable cause), we can also negotiate with the prosecution to seek a favorable plea agreement. A plea agreement might involve a plea to a lesser offense or an agreement on sentencing that will significantly reduce the penalties you face.

Homicide Defense Strategy

We will take the time to talk to witnesses, investigate what really happened in your case, understand what evidence is in the prosecution’s possession, look for holes in the prosecution’s case, and determine if the police violated your constitutional rights or made other critical errors that can be used to your advantage.

We are committed to raising a strong and comprehensive defense on your behalf. Depending on the facts of your case, the following defenses and strategies may be helpful:

  • Self-Defense
  • Insanity
  • Mistaken Identity
  • Suppression of Evidence

  • Challenging Ballistics Evidence (Relating to Firearms and Bullets)
  • Challenging the Reliability of an Eyewitness
  • Challenging Whether the Evidence Sustains a Murder Conviction
  • Negotiation with the Prosecution to Determine if a Plea Agreement Could

Significantly Minimize the Charges or Penalties you Face

You can be confident that you will have a highly skilled and dedicated defense lawyer who will advise you of your rights, help explain the process and work diligently to seek the best possible outcome on your behalf.

Robberies in Phoenix On the Rise

Reward for Phoenix Robbery Suspect

Yet another robbery has taken place in good ol’ Phoenix. However, this time, if you could help the authorities you could make a little cash. A $1,000 reward is being offered if you have any information that could help the police track down the two men that robbed a Phoenix body shop at gunpoint on January 25th.

Silent Witness have released images of the two men that police say entered the Estrada Body Paint & Auto Repair. The Auto Repair shop is located close to 13th and Washington streets around 12:35 p.m. kind of odd to rob someone at lunch time.

One of the suspected men walked behind the counter and then pointed a gun at the clerk and demanded the money. The other man was the lookout man.

Suspect at Large

Silent Witness says that police are now looking for a Hispanic man. They think that he is around thirty years old and around five foot, nine inches tall. He weighs around two hundred pounds. He also has black hair and brown eyes. They also say he has a beard. At the time he was wearing a black hat and black boots and blue work pants.

The lookout man was described as having a beard and was wearing an Oakland Raiders hoodie. Not much to go on with that one.

If anyone has any information, please call Silent Witness at 480-WITNESS. Don’t forget, if you help out you could get a little cash for you trouble!

FBI Searches for Bank Robber

Usually when you think of a robbery you think of a group of guys because that’s what you see in the movies. Well this time, the FBI is asking for the public’s help in finding a woman who is wanted in the connection of multiple bank robberies around the metro Phoenix area in just the last month.

Apparently, Phoenix likes to name their robbery suspects bandit because her name is “SOS Bandit”. Why? because of her “slip on shoes”. She has robbed at least four banks between January 30th and February 16th using the same plan in each of the robberies according to an FBI press release.

The woman entered the banks and acted as if she was just a regular customer however after a few moments that changed. She presented a note to the tellers demanding money, threatening “physical harm” if her demands weren’t met.

The woman is linked to robberies at:

  • Amtrust Bank at 8764 E. Shea Boulevard in Scottsdale on Jan. 30.
  • Amtrust Bank at 2975 W. Ray Road in Chandler on Feb. 11.
  • Bank of America at 8750 E. Raintree Drive in Scottsdale on Feb. 15.
  • JP Morgan Chase at 1744 E. Southern Ave. in Tempe on Feb. 16.

Criminal Defense Cases

Formerly referred to as terroristic threats, the crime of criminal threats may be charged as a misdemeanor or a felony offense, depending on case specifics. A criminal threat occurs when an individual threatens to kill or injure another person and that person has a reasonably sustained fear for his or her safety, or the safety of his or her immediate family. A defendant may potentially be convicted of making criminal threats even if he or she did not intend to carry out the threat, provided that the alleged victim had a reasonable basis to fear for his or her safety.

Arrest in Phoenix for Criminal Threats

If you have been arrested for making a criminal threat, it is critical that you protect your rights by retaining an experienced criminal defense attorney. For a vigorous defense, contact the Law Offices of Criminal Defense Lawyers PLLC immediately.

Arizona prosecutors have considerable discretion to charge criminal threats offenses as a misdemeanor or a felony. If you are convicted of a misdemeanor criminal threat, harassment or stalking offense, you could face up to one year in county jail. If you are convicted of a felony criminal threats offense, you could face up to four years in state prison. You could face significantly greater penalties if you used a firearm or other dangerous weapon while making criminal threats.

Types of Criminal Threats

A Criminal Threat is a strike offense, which means that you could face significantly enhanced penalties if you are convicted of a future felony. Even a nonviolent felony could result in twice the prison sentence if you have a prior strike offense. A third strike could result in a prison sentence of 25 years to life.

Criminal Threats Defensive Strategy

There are many ways that our skilled Phoenix Defense Attorneys can raise a strong defense on your behalf. First, we will examine the facts of the case to determine if the prosecution has enough evidence to obtain a conviction. In particular, we will look at any evidence of the alleged communication. Does the prosecution have copies of an email or voicemail? If the state has nothing more than a he-said-she said case, the prosecution will have a tougher time proving its case.

Taking Your Criminal Threats Case to Trial

Even if the prosecution has evidence of the alleged communication, we will examine the nature of the communication. Was the threat a serious one? In other words, did the alleged victim actually fear for his or her safety and was he or she reasonable to have such fear? The prosecution does not have to prove that you intended to carry out the threat, or even that you had the current ability to carry out the threat. However, the prosecution must establish that the threat you made is the type that would have caused the defendant to have a reasonable fear.

If you choose to take your case to trial, we offer skilled Phoenix trial lawyers who will aggressively defend your rights in the courtroom. If you do not want to fight your charges at trial, we can negotiate with the prosecution to seek a favorable plea agreement. Depending on the facts of your case, we may be able to help you keep this off of your record. If that is not possible, we can seek a plea to a lesser offense, including a non-strike offense, or we can seek an agreement on sentencing that will limit the penalties you face. With a team of former prosecutors, the skilled attorneys at the Phoenix Offices of Criminal Defense Lawyers PLLC are highly adept at finding creative solutions for their clients.

Phoenix Robberies on the Rise

Phoenix Robberies Suspect Arrested

So, in 2017 when you think of a robbery suspect you don’t really think of an old timey alias name. However, it still happens apparently.

Recently a robbery suspect has been dubbed as the “Barrel Chested Bandit”. Talk about something out of a “Gunsmoke” Western. Anyways, the “Barrel Chested Bandit” is wanted for holdups in Texas, New Mexico, and Arizona has finally been arrested. This news came from the FBI office in Dallas.

According to the FBI agents, they arrested fifty year old, Anthony James Lane in Tuscon, Arizona on Tuesday. The name “Barrel Chested Bandit” is kind of a let down, totally though that was a badbutt female name. Kind of like a Annie Oakley or something, apparently not.

Lane was a busy man and wanted for several robberies or attempted robberies at eight different banks ranging from Tuscon, Albuquerque to Amarillo and Longview.

According to the FBI press release, he got his name by brandishing a small handgun in each of the robberies. He would order the teller to give him the money and then flee on foot.

Earlier this month the FBI said that they had offered a $10,000 reward for tips leading to the “Barrel Chested Bandit” arrest. Now he will face a federal bank robbery charge in Arizona.

Phoenix Police Suspect Shooting

Circle K seems to be a popular place to have a shooting in Phoenix because yet another shooting has taken place. According to the Pima County Sheriff’s Department they have identified a man that the deputies fatally shot outside of the Circle K on Sunday, as twenty-six year old, Manuel Encinas.

The Deputies responded to an armed robbery call at a local Circle K convenience store. According to the Sheriff’s Department spokesman, the incident happened around two o’clock in the morning when they saw Encinas standing behind the Circle K employee.

The man was holding a gun, forcing the employee out of the store. After they left the store the employee ran or his or her life toward a deputy that was standing south of the building.

During that time, the deputies were able to get a clean shot and were able to shoot and kill Encinas after he had “presented a gun”.

According to further investigation that Encinas was also connected to a previous Tucson homicide so it looks like he will be spending some time in jail. While no further details were given on that situation, this shooting is still being investigated.

Car Incidents Leading to Death

Man Found Dead in Burning Car

People are getting so cruel nowdays. Police recently found a man inside of a trunk of a burning car.

The police officers as well as the firefighters found forty year old, Dustin Jones inside of the trunk of an abandoned car after a police chase.

The vehicle was a white Honda Civic which belonged to Jones. The car was taken by unknown suspects. Talk about a horrible situation.

The officers were called to the scene at Cave Creek Road around 3:30 in the morning on March 30th. This was for a report of a person being threatened with a gun. How scary that must have been for Jones.

The vehicle involved was spotted at a local service station at Cave Creek and Beardsley Roads. The officers tried to do a traffic stop to get to the suspect but that didn’t work. They then started a car chase when the driver fled from the officers and turned west on Grovers Avenue.

The officers tried to quickly catch up with the suspect but they didn’t’ catch up with him until the 2200 block of West Grovers Avenue and then found that the car was engulfed in flames. The car’s two suspects fled on foot. The Phoenix firefighters were able to put the fire out, however they then found a dead body in the trunk.

Homicide in Alley

Another homicide in Phoenix. The police say that a twenty-seven year old man was found dead in an alley in Phoenix. He was found near Oak and 12th streets.

The Police were called to the scene around 7:30 in the morning.

Police are calling this a homicide and say that the circumstances around the victims death are “suspicious” and they will continue to investigate.

The victim’s name hasn’t been released at this time.

Phoenix Manslaughter Lawyer

At the Phoenix based Offices of Criminal Defense Lawyers PLLC, we have defended many clients charged with a violent crime, including murder charges and other high-level violent crimes. We can provide the strong defense you need if you have been charged with voluntary manslaughter or involuntary manslaughter.

If you discovered your spouse in bed with a lover and as a result killed your spouse in a sudden rage, you may have been charged with first-degree murder. However, you may only be guilty of voluntary manslaughter, an offense that carries a maximum prison sentence of 11 years, as opposed to a life sentence.

Manslaughter is defined as the unlawful killing of a human being without malice. The term malice is used in a highly technical sense and does not simply imply a feeling of anger.

Types of Manslaughter Defenses

If you have been charged with murder and the evidence is stacked against you to show that you did unlawfully kill another person, seeking a conviction to the lesser charge of voluntary manslaughter may make a significant difference in your case.

To effectively raise such a defense, you must be able to establish that you were provoked, that a reasonable person in such a situation might be similarly provoked to kill, and that you did not have sufficient time to cool off and further contemplate your actions. If retained as your counsel, we will thoroughly investigate the facts of your case to determine which defense strategy gives you the best opportunity to protect your freedom.

Types of Manslaughter Cases in Phoenix

In the state of Arizona, you may be charged with involuntary manslaughter under two separate circumstances:

  • If you committed a crime (other than a felony) and unintentionally caused the

death of another person.

  • If you were engaged in a lawful act that might cause death and acted without

“due caution and circumspection.”

Manslaughter Conviction and Sentencing

A conviction for involuntary manslaughter carries a maximum sentence of four years imprisonment. If you caused the unintentional death of another person and you were not committing a crime, it is not sufficient for the prosecution to allege that you made a mistake. The phrase “without due cause and circumspection” implies something more than a simple mistake. Our Phoenix Attorneys can raise a number of issues and defenses on your behalf to raise the strong defense you need. A plea to a lesser offense or a plea that allows you to avoid a criminal conviction may be possible depending on the facts of your case. If you choose to fight your charges at trial, we have the skilled trial lawyers to aggressively defend your rights in the courtroom.
